      Be it known, that I John Michael of the county of
      Hancock and state aforesaid, that sometime in the year one thou
      sand seven hundred and ninety four, or five, sell and convey unto
      Peter Bird of said county and State, a certain tract of land or parcel
      of land on the North side of Powels Creek. Containing by
      a late survey one hundred and sixty six acres or thereabout, say
      more or less, adjoining Belliland[?] and the tract of land formerly
      belonging to Lobmore[?] Jordan now belonging to Isaac Battle, for
      which I have received the consideration money in full and made
      him a Deed of Conveyance for the same. And the said
      Peter Bird having since departed this life, and I have been inform
      ed by Abraham Rawls, acting administrator to the Estate
      of the said Bird, that the aforesaid Deed has been destroyed
      by fire, without ever been Recorded, and in order that the
      legal heirs of said Bird may attain[?] noenjing[?] thereby. I the said
      John Michael do hereby bind myself my heirs and assigns in
      the penal sum of twelve hundred dollars, to warrant and
      forever defend the said tract of land and premises against the
      claim or claims of all and every person or persons whatsoever,
      with the legal heirs of Peter Bird deceased, namely, James Bird for him
